Terms of Service

1) Acceptance of Terms

By accessing or using MaxWin (the "Service"), you agree to these Terms of Service (the "Terms") binding you and MaxWin ("Company," "we," "us," or "our"). If you do not agree, do not use the Service.

2) Changes to the Terms

We may update these Terms at any time. Changes are effective upon posting to the Site or App. We may provide notice of material changes via banner, email, or in-product notice. Your continued use constitutes acceptance.

3) Acceptable Use

3.1 You may not misuse the Service, manipulate outcomes, abuse platform features, or interfere with other users.

4) Accounts

4.1 One account per person. Provide accurate information and keep credentials secure. You are responsible for all activity under your account.

4.2 We may refuse, suspend, or close accounts at our sole discretion.

5) Virtual Credits ("Coins")

5.1 Deposits convert to Coins (an internal balance). Coins are not bank accounts and have no intrinsic cash value; they are a limited, revocable license to access features of the Service.

5.2 We may adjust, freeze, or reverse Coin balances to correct errors, prevent fraud, or resolve disputes.

6) Fees (Read Carefully)

6.1 Entry Fee (10%): For each accepted match, there is a 10% platform fee. The winner receives 90% of the pot.

Example: Two players stake 10.00 each → pot 20.00 → platform fee 2.00 → winner's payout 18.00.

6.2 Withdrawal Fee (10%): Each withdrawal is subject to a 10% fee plus any network/miner fees.

6.3 Fees are earned and non-refundable once incurred, except where expressly stated by us in writing.

6.4 We may change fee rates prospectively with notice.

7) Matches, Escrow, Results & Disputes

7.1 When a match is accepted, each participant's Coins may be escrowed. If the match is cancelled by us before it begins, we may return escrowed Coins and not charge the entry fee.

7.2 Players must submit results and required evidence within the stated time. Failure may lead to forfeit.

7.3 Disputes: Our admins may review evidence (including screenshots/video/metadata/chat logs/match history) and decide outcomes in our sole discretion. Possible remedies include awarding a winner, split, rematch credit, refund, forfeit, or account action. Our decision is final. Platform fees may be retained.

7.4 Disconnections: Each player is allowed to disconnect once during a match for up to 5 minutes and reconnect. If a disconnect occurs mid-round, that round is counted and played to completion. If a disconnect occurs between rounds, the match pauses and resumes from the current score upon reconnection. Failure to return within 5 minutes results in forfeit.

7.5 Anti-abuse: Collusion, smurfing, multi-accounting, throwing, exploiting bugs, or any attempt to manipulate outcomes may result in voided matches, forfeitures, fees retained, and account closure.

8) Deposits & Withdrawals

8.1 Funding and withdrawals may be made in supported currencies/networks only. Processing times can vary; delays may occur for verification, compliance review, technical issues, or network congestion.

8.2 We may hold, suspend, restrict, condition, offset, reverse, cancel, or refuse any deposit, balance credit, transfer, escrow release, or withdrawal request at any time, for any reason or no stated reason, in our sole discretion.

8.3 We may set off or deduct from your balance any amounts you owe us (including fees, chargebacks, adjustments, penalties, or losses from your misuse). If your account shows a negative balance, you agree to repay it and authorize us to recover it from future deposits or payment methods on file.

8.4 You acknowledge funds and balances may be held by us, our affiliates, custodians, payment processors, or blockchain wallets under our control, and are not required to be segregated, insured, or held in trust for your benefit.

9) Geo Restrictions

You agree to provide accurate information and not use VPNs, proxies, or falsified location or identity data. We may restrict or block access in prohibited jurisdictions or where the Service is not offered.

10) Prohibited Conduct

You may not: (a) use the Service for fraudulent or infringing purposes; (b) interfere with matches, systems, or other users; (c) circumvent limits or fees; (d) scrape, reverse engineer, or misuse data; (e) create multiple accounts; or (f) trade Coins off-platform.

11) Suspension, Termination & Forfeiture

We may suspend or terminate access, place holds, freeze balances, decline to settle or pay out any amount, reverse credits, forfeit escrow or winnings, and/or retain fees at any time, with or without notice, for any reason or no stated reason, in our sole discretion, including where we suspect violations of these Terms or where we act to protect users, the platform, or our business.

12) Intellectual Property & Branding

The Service, content, and trademarks are owned by Company or its licensors. Use does not grant any rights except a limited license to access the Service.

13) Disclaimers & Risk Notice

13.1 No Warranty. The Service is provided "as is" and "as available." We disclaim all warranties.

13.2 Skill & Outcome Risk. Outcomes depend on player performance, connectivity, platform rules, and admin determinations. You may lose stakes and pay fees. Network or system outages can occur.

13.3 No Financial/Legal Advice. The Service is not investment, financial, or legal advice.

14) Limitation of Liability

Company and its affiliates will not be liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) lost profits, data, goodwill, or opportunities; or (c) amounts exceeding the greater of (i) fees you paid to us in the three (3) months before the event giving rise to the claim or (ii) $100.

15) Indemnification

You agree to indemnify, defend, and hold harmless Company, its affiliates, and personnel from claims, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your matches, your content, your breach of these Terms, or infringement of third-party rights.

16) Miscellaneous

If any provision is unenforceable, the remainder remains in effect. We may assign these Terms; you may not without our consent. These Terms (plus any incorporated policies or rules posted in-product) are the entire agreement between you and us regarding the Service.
